Terms and conditions

These terms govern the use of CERQA Crew, the staff and housekeeping app, by the companies that subscribe to it and the employees whose accounts those companies create. By using the app you accept them.

Who the parties are

CERQA provides the software. Your employer operates it for you: they create your account, set your role, plan your shifts and answer for the employment relationship. Nothing in the app changes your employment contract.

Accounts and access

  • Your employer creates your account from the web dashboard; the app does not create accounts.
  • Keep your credentials private and tell your employer immediately if you suspect someone else is using your account.
  • The app is a PWA that installs from a link; native iOS and Android apps are in development and the same terms will apply to them.

Clock-in, location and records

  • Clocking in and out creates employment records. You must clock only your own working time, from your own device.
  • Location is captured only at the moment you clock in or out, and only if you granted the location permission. Denying the permission does not block the punch.
  • Time and absence records are kept by your employer for the period the law requires; they are not erased on request while that obligation exists.

Acceptable use

  • Do not use chats, feeds or forms to send abusive, discriminatory or illegal content.
  • Do not share internal content — rosters, colleague data, guest information — outside the company.
  • Do not attempt to access another employee's account or data you are not authorised to see.
  • Your employer may moderate and remove content posted on the feed and in chats.

The CERQAI assistant

CERQAI answers questions about your shifts, hours, absences and company documents. It is automated and can be wrong. Decisions about your employment are made by people at your company, not by the assistant.

Availability

We work to keep the app available, but it can be interrupted for maintenance, upgrades or reasons outside our control. If the app is unavailable, follow your company's fallback procedure for clocking and reporting.

Data protection

Personal data is processed as described in the privacy policy. Your employer is the data controller and CERQA acts as processor under a data processing agreement. To delete your account, see the account deletion page.

Liability

CERQA is liable for the operation of the software. It is not liable for employment decisions, rostering or payroll, which belong to your employer. To the extent permitted by law, we exclude liability for indirect and consequential loss. Nothing here limits liability that cannot be limited by law.
